United States Seventh Circuit

Via v. LaGrand, 04-4011

Denial of summary judgment on grounds of qualified immunity for one defendant in a 42 U.S.C. section 1983 suit against employees and officials of the Department of Child Protection is dismissed for lack of jurisdiction where courts may not conduct an interlocutory review of orders for summary judgment involving qualified immunity insofar as the orders determine whether or not the pretrial record sets forth a 'genuine' issue of fact for trial.
