Northcutt v. General Motors Hourly-Rate Employees Pension Plan, 05-4484
Summary judgment for automobile manufacturer is affirmed where the suspension of plaintiffs' benefits by the employer, and the treatment of the amount otherwise due to the plaintiffs each month as reimbursement for past disability and pension plan overpayments, is affirmed where section 502 of ERISA does not prevent defendant from invoking contractual remedies for reimbursement instead of seeking equitable relief before a court.
