United States Seventh Circuit

Johnson v. Hanks, 06-1509

In a challenge to a prison disciplinary board's revocation of 30 days of good-time credits, the district court should have held an evidentiary hearing since the prisoner's version of the facts differed from the board's, and facts found (or assumed) by a prison disciplinary board are not entitled to the presumption of correctness given to judicial findings.
