U.S. v. Barker, 05-2861
Conviction and sentence for possession of a firearm by a felon and participation in a straw purchase of firearms are affirmed where: 1) the defendant was not in law enforcement custody when he confessed to the crimes; 2) the government's failure to disclose evidence did not rise to the level of a Brady violation since the defense still had time to act on the evidence; and 3) defendant did not demonstrate that the court relied on factually inaccurate information during sentencing.
