U.S. v. LaGrou Dist. Sys., Inc., 05-3361

Convictions for violations of the health and safety codes for cold storage of food products are affirmed over defendant's argument that jury instructions improperly subjected defendant to strict liability for felony offenses. Sentence on one count is vacated and remanded where the district court had no authority to sentence defendant in excess of the default statutory maximum absent a jury finding beyond a reasonable doubt.
