Hefferman v. Bass, 05-2753

Dismissal of an action for legal malpractice, fraud and breach of fiduciary duty is reversed where: 1) the court erroneously applied Illinois' fact-based pleading standard to the complaint; 2) the complaint satisfied the notice requirements of Federal Rule of Civil Procedure (FRCP) 8 for the legal malpractice and breach of fiduciary duty claims; and 3) the complaint satisfied FRCP 9's heightened pleading standard for the fraud claim.
