O'Malley v. Litscher, 05-3415
Dismissal of an 18 U.S.C. 1983 suit by a prisoner alleging violations of due process, the Eighth Amendment and the Religious Land Use and Institutionalized Persons Act is affirmed, but with modifications to the district court's order such that the dismissal with respect to the RLUIPA and Eighth Amendment claims becomes jurisdictional since they violate the Rooker-Feldman doctrine.
