Paul v. Theda Med. Ctr., 06-1034

Summary judgment for defendant hospital in a suit by a physician alleging race discrimination is affirmed where: 1) plaintiff failed to present evidence that he was qualified for the job in question and that the defendant treated other similarly-situated employees who were not members of the class more favorably; and 2) the hospital did not violate its bylaws by denying defendant active staff membership.
