McConville v. Sec & Exch. Comm'n, 05-3510

Petition for review of a cease-and-desist order from the SEC directing petitioner to refrain from committing or causing any further violations of federal securities laws is denied where the Securities Exchange Act requires the court to give highly deferential, conclusive effect to the SEC's factual findings so long as they are supported by substantial evidence in the record, and there was substantial evidence that the petitioner violated the portions of the Act in question.
