United States Seventh Circuit

U.S. v. Leahy, 05-2639

Convictions, pleas and sentences for RICO violations, mail and wire fraud statutes, money laundering, and tax offenses in a scheme to defraud the city of Chicago and various insurers are affirmed over defendants' numerous challenges to the indictments, the sufficiency of the evidence, the evidentiary decisions of the trial court, the jury instructions, decisions by the sentencing judge, and imposition of restitution to the city. One defendant's sentence is remanded for re-calculation of the offense level and restitution amount consistent with the court's decision concerning the extent of defendant's involvement with the insurance fraud.
