Judgment as a matter of law for defendant-city in a suit alleging violation of the 4th Amendment and intentional infliction of emotional distress surrounding the detention of an innocent man on murder charges is reversed where the plaintiff was entitled to judgment as a matter of law on the issue of his right to a prompt judicial determination of probable cause, and there was conflicting evidence at trial on his constitutional claim relating to the conditions of his warrantless detention and his state law claim for intentional infliction of emotional distress.
