Declaratory judgment for employer in dispute over membership in a Union collective bargaining agreement (CBA) is affirmed where the district court did not err by deciding the question of whether plaintiff-employer had terminated an earlier CBA, where this was necessary in order to resolve the question of the arbitrability of the grievance under a later agreement.
