Sperandeo v. Lorillard Tobacco Co., 05-1916

Summary judgment for the administrator of an ERISA disability plan is affirmed where the district court was correct in determining that de novo review was the proper standard of review and correct in denying benefits based on a neurological disorder, but reversed where plaintiff raised a material issue of fact regarding his work duties in relation to a shoulder injury.
