Gutierrez v. Gonzales, 05-2011

Petition seeking an order estopping the government from enforcing a deportation order obtained through the misconduct of his attorney is denied where the government's conduct of acting on information provided voluntarily to it indicating a violation of the immigration laws cannot constitute the type of egregious affirmative misconduct necessary to justify the extraordinary remedy of estoppel.
