U.S. v. Valle, 03-3293

Re-sentence for bank robbery is affirmed where: 1) the district court did not determine as a matter of law that defendant was a career offender; 2) the district court did not need to establish a precise link between the degree of the departure and the structure of the Guidelines; 3) the district court's reliance on a contested statement did not render the sentence unreasonable; and 4) the overall sentence was reasonable.
