Hidayat v. Gonzales, 04-4195

Denial of motion to reopen removal proceedings is affirmed where defendant's subsequently approved visa petition did not, as a matter of law, allow him to remain in the U.S., and the court has no jurisdiction over the Attorney General's decision to commence the proceedings.
