Acevedo v. Canterbury, 04-4292
Judgment as a matter of law for defendant-police officer in a 42 U.S.C. 1983 suit alleging excessive force and false arrest is reversed where: 1) a police officer who files a false report may be liable for false arrest if the filing of the report leads to a seizure in violation of the Fourth Amendment, even if he did not conduct the arrest himself; and 2) a blow by a police officer that immobilizes the recipient qualifies as a seizure for excessive force analysis.
