U.S. v. Drake, 04-4240

Conviction for possession of a firearm by a felon is affirmed over arguments that the gun should have been suppressed and that the court erred in its jury instructions regarding defendant's prior convictions, but the sentence is vacated and remanded to determine whether the court would have given the same sentence under an advisory guidelines regime.
