Dolis v. Sheahan, 05-3781

Respondent's petition for rehearing of an order granting a certificate of appealability from the district court's dismissal without prejudice of petition for habeas corpus is denied where the petitioner was precluded from remedying defects in his petition by the federal habeas corpus statute of limitations, thus the dismissal was a final order which was within the appellate jurisdiction.
