Sentence for conspiracy to possess and distribute narcotics is affirmed where: 1) judicial fact-finding did not warrant reversal; 2) the court's justification for imposing an above-guidelines sentence was commensurate to the difference between the sentence imposed and the advisory range; and 3) sentencing disparity between defendants did not demonstrate error.
