United States Seventh Circuit
U.S. v. Tyra, 05-2734
Sentence for distributing crack is affirmed where district courts do not have to recite any specific language to satisfy Booker concerns, but merely: 1) calculate and consider the proper Guidelines range in an advisory capacity; 2) allow defendants to point out any of the section 3553(a) factors that might justify a sentence outside of the Guidelines range, and consider those factors when determining the sentence; and 3) give meaningful consideration to the factors and articulate which factors influenced its decision.
