McMillan v. Collection Professionals, Inc., 05-2745

Dismissal of a claim against a debt collection agency under the Fair Debt Collection Practices Act is reversed where the inquiry into how an unsophisticated consumer would interpret a collection letter is necessarily fact-bound and requires that the plaintiff have an opportunity to demonstrate a factual basis for the allegations.
