United States Seventh Circuit
U.S. v. Rodriguez, 05-4786
Conviction for illegal re-entry into the U.S. is affirmed over defendant's arguments that Texas, an immigration fast-track state, was the proper venue for the charges since he was first apprehended there. The "found" component of the offense is ongoing, and occurs wherever the alien is, not just where he is first identified by authorities.
