Tartt v. Northwest Cmty. Hosp., 04-3939

Dismissal of a suit under the Uniformed Services Employment and Re-employment Rights Act of 1994, 38 U.S.C. sections 4301-4333, is affirmed where the suit was barred by res judicata since an identical suit had been dismissed for failure to state a cause of action and failure to prosecute, and had not been timely appealed.
