James Cape & Sons Co. v. PCC Constr. Co., 05-3894

Dismissal of antitrust and RICO suit is affirmed where: 1) plaintiff did not show injuries that reflect the anticompetitive effect of either the violation or the anticompetitive acts made possible by the violation; and 2) bid-riggers did not exercise sufficient control over the Wisconsin Dep't of Transp. to support plaintiff's RICO claim.
