Simpson v. Nickel, 05-4686

Dismissal of a prisoner's suit alleging retaliation for a petition for redress of grievances is vacated and remanded where: 1) plaintiff did not need to allege either factual or legal elements of the case in his complaint; and 2) state law allows for federal review of a prison disciplinary board decision.
