Backwater, Inc. v. Penn-Am. Ins. Co., 05-2805

Summary judgment for defendant-insurer in a bad faith claim is affirmed where the insurer acted in good faith since conflicting inferences could be drawn from the facts, and jury verdict for defendant on breach-of-contract claim is affirmed where there was no plain error in the exclusion of testimony or the order of jury instructions.
