Pourghoraishi v. Flying J, Inc., 05-1107
Dismissal of 42 U.S.C. 1981 and 1983 claims in a case involving alleged racial discrimination during an arrest is affirmed where the defendants in the 1981 claim could not know that the plaintiff belonged to a protected category, but reversed where there was a material question of whether the arresting officer had probable cause to arrest the plaintiff.
