Estremera v. U.S., 05-2278
Summary judgment for government in challenge to penalties imposed under Food Stamp Program regulations is affirmed where: 1) evidence supported district court's conclusion that sale of store previously in violation had occurred; 2) the district court applied the appropriate standard of review; and 3) the court did not err in finding that the penalty was not arbitrary or capricious.
