Dougherty v. Indiana Bell Tel. Co., 05-2066
Summary judgment for defendant in an action by an employee against an employer for insurance benefits is affirmed where: 1) there was no evidence of bias that would warrant a review less deferential than the arbitrary-and-capricious standard; 2) termination of accident benefits had rational support in the record; and 3) plaintiff failed to exhaust administrative remedies for part of her claim.
