US ex rel. Gear v. Emergency Med. Assocs. of Illinois, 05-2235 & 05-3202

Summary judgment for defendants in a qui tam action under the False Claims Act alleging that defendants fraudulently billed Medicare for services performed by residents as if the services had been performed by attending physicians is affirmed where the district court correctly found plaintiff's suit barred.
