Byrd v. Illinois Dep't of Public Health, 04-1416

In an employment discrimination suit, judgment in favor plaintiff on his retaliation claim is vacated and remanded for a new trial where one of the jury instructions misstated the legal effect of information supplied by a person who was not a decision maker as to the terms of plaintiff's employment.
