MOHAMMAD v. ASHCROFT, 03-1554

The Illegal Immigration Reform and Immigrant Responsibility Act (IIRIRA) reinstatement provision, 8 U.S.C. section 1231(a)(5), may not be applied retroactively to aliens who reentered the United States and applied for discretionary relief prior to IIRIRA's effective date.
