HAYWOOD v. CITY OF CHICAGO, 03-3175

In an illegal possession of a firearm case, the district court's grant of summary judgment against plaintiff's claim of false arrest is affirmed. However, defendant's continued detention ordered by the judge was error where, under the Fourth Amendment, he could not be held in custody longer than 48 hours without probable cause that he committed a crime.
