United States Seventh Circuit

SIMPSON v. US, 04-2700

Plaintiff's collateral attack unsuccessfully challenged his conviction under Blakely v. Washington, 124 S. Ct. 2531 (2004), because the Supreme court has not made the Blakely rule applicable to cases on collateral review and therefore, the proposed claim is premature.
