United States Seventh Circuit

US v. GARCIA, 04-1006

The Court reversed the district court's granting of a motion to suppress in favor of defendant, finding that defendant's detainment was an acutal arrest, and therefore the police officer's presence in a place where evidence of crime was in plain view did not violate the Fourth Amendment.
