United States Seventh Circuit

HILEMAN v. MAZE, 02-4041

Defeated incumbent's section 1983 claim was improperly dismissed as untimely. Her claim accrued on the date on which she lost the election, not the date police seized the fraudulent ballots; the "operative decision" occurred when the state officials decided to commingle the fraudulent ballots with the legitimate ballots.
