Claim that defendant's mandatory retirement program for police and firefighters amounts to subterfuge to evade the purposes of the ADEA must be dismissed. Because the ADEA expressly permits such retirement programs, proof that local officials exercised this right for impure motives will not in and of itself suffice to establish subterfuge for purposes of 29 U.S.C. section 623(j)(2).
