AUBUCHON v. KNAUF FIBERGLASS, GMBH, 03-1382
Unless the employer already knows that the employee has an authorized ground for leave under the Family Medical Leave Act (FMLA), the employee must place the employer on notice of a probable basis for FMLA leave. Doing so triggers the employer's duty to request such additional information from the employee's doctor or some other reputable source as may be necessary to confirm the employee's entitlement.
