INDIANA BELL TEL. CO., INC. v. MCCARTY, 03-1123, 03-1122, 03-1124

With the exception of the provision requiring plaintiff to perform "acceptance testing" - which is a valid exercise of state authority preserved under the Telecommunications Act - the district court correctly assessed various challenges to provisions established by the state utility commission through arbitration and incorporated into the approved interconnection agreement.
