MILITELLO v. CENT. STATES, S.E. & S.W. AREAS PENSION FUND, 02-3058

Defendant's Board of Trustees reasonably determined that by owning and operating a trucking business, plaintiff was engaging in "Prohibited Reemployment" as defined by the pension plan. Suspension of pension benefits was not unlawful; defendant can recoup the benefits already paid.
