United States Seventh Circuit

US v. SAUNDERS, 02-2884

Because defendant's own testimony introduced his 1983 murder conviction, he cannot appeal the application of Federal Rule of Evidence 403 to admit evidence of that conviction for the purpose of impeaching his testimony. Because he lied about the central issue at his trial, the enchancement under U.S.S.G. section 3C1.1 is affirmed.
