DOE v. CITY OF CHICAGO, 03-2221
FRCP rule 54(b) judgment for the City, on a tortious misconduct claim arising from alleged sexual harassment by one of its police officers, is vacated. The issue of the City's responsbility for the torts of its police officers is a difficult one that the district judge should not have attempted to resolve before the actual facts bearing on the issue were determined; indemnity should not have been decided before liability.
