US v. HOWELL, 03-1688

District court erred in holding that it lacked subject-matter jurisdiction over plaintiff's petition for the return of his BMW, seized and administratively forfeited prior to his drug conviction. On remand, court should consider plaintiff's noncompliance with the procedural requirements for maintaining a federal civil suit, and the limitations on his ability, as a prisoner, to bring such suits.
