PRIMECO PERSONAL COMMUNICATIONS, L.P. v. CITY OF MEQUON, 03-1514, 03-1548

Planning commission violated the Telecommunications Act section 332(c)(7)(B)(iii) by failing to support with "substantial evidence" its decision to deny a permit to erect a cellphone antenna. 42 U.S.C. section 1983 remedies are not available in suits to enforce rights granted by the Telecommunications Act.
