AT&T COMMUNICATIONS OF ILL., INC. v. ILL. BELL TEL. CO., 03-2735, 03-2766

District court's injunction is affirmed where the Telecommunications Act of 1996 preempts 220 ILCS 5/13-408 because, 1)federal law makes the state regulatory commission the exclusive source of non-federal substantive rules, and 2) the particular statutory rules for the handling of fill factors and depreciation conflict with TELRIC.
