US v. FALLON, 03-1330
Conviction for bank fraud in violation of 18 U.S.C. section 1344(1) is affirmed where 1) district court did not abuse its discretion in denying a new trial because there was not Brady violation, 2) the "ostrich" instruction was properly given, and 3) prior convictions were properly admitted as impeachment evidence under Rule 609(b).
