SCOTT v. EDINBURG, 02-4085

In a 42 U.S.C. section 1983 action involving an off-duty police officer, the district court's grant of summary judgment was affirmed where there was a question of fact as to the reasonableness of defendant's use of deadly force for self defense, but deadly force was found to be reasonable under the Fourth Amendment in order to protect third parties in danger.
