United States Seventh Circuit
N. BORDER PIPELINE CO. v. 64.111 ACRES OF LAND IN WILL COUNTY, 02-3734
In an action for valuation after a natural-gas pipeline condemned private land, the district court did not clearly err or abuse its discretion in concluding that Fed. R. Civ. P. 71A(h) supersedes 15 U.S.C. section 717f(h), permitting the court to choose among a bench trial, a jury trial, and valuation by a commission.
