MOTHER v. CASSIDY, 01-2832

The district court may not transfer the determination of costs allowed under FRCP 54(d) for a prevailing defendant to a state court that has before it certain state law claims that were originally part of the federal suit, when the plaintiff has voluntarily dismissed her federal claims with prejudice under FRCP 41.
